Enrolment Terms and Conditions

By enrolling on our website, by clicking “Accept” at the time of enrolment or by signing an “Application For Enrolment” (‘enrolment form’) and forwarding that form to H1 Digital Education, the Student has agreed with H1 Digital Education to comply with these terms and conditions (‘terms’). These terms supersede and prevail over any other terms and conditions included in any purchase order, confirmation or other document or communication from the Student to H1 Digital Education.

  1. Definitions

1.1. ‘Employer’ means the person described in the enrolment form attached to these terms who employs the student.
1.2. ‘Extension’ request for course completion beyond original course end date.
1.3. ‘Deferment’ request for course completion beyond original course end date (maximum of 6 months)
1.4. ‘GST’ means GST as defined in the A New Tax System (Goods and Services Tax) Act 1999 as amended from time to time or any replacement or other relevant legislation and regulations.
1.5. ‘Accept’ by selecting this button for online enrolment on our website or, by enrolling via any H1 Digital Education “Application For Enrolment” paper forms (‘enrolment form’), you are confirming that you have agreed to the H1 Digital Education terms and conditions.
1.6. ‘Student’ means the person described in the enrolment form
1.7. ‘Training course’ or “course” means the BSB50215 Diploma Of Business (Digital Marketing)
1.8. ‘Training materials’ means any materials provided by H1 Digital Education to the student with respect to a training course including without limitation, any course notes, data presentations, case studies and assessment activities.
1.9. ‘Course fees’ are fees applicable to all students enrolled for specific study at H1 Digital Education.
1.10. ‘Upfront payment’ the total amount of the course expense in one lump sum at enrolment.
1.11. ‘Payment plan arrangement’ is the initial deposit paid upon enrolment and the remaining balance paid off over 10 month period (note: payment plan includes additional fees).
1.12. ‘Fee payer’ a student/employer who is enrolled in a fee paying place and who pays fees for their course.
1.13. ‘Additional fees’ on top of course fee.
1.14. ‘Learning guarantee’ a free 3 month course extension available if applicable, for students to complete their qualification.
1.15. ‘H1 Digital Education” means Training Services Management Pty Ltd t/as H1 Digital Education ABN  58 600 376 065  PO Box 37, Albion, Queensland 4010. H1 Digital Education courses are delivered by Training Services Management Pty Ltd and qualifications are awarded by Training Helps Pty Ltd RTO# 32518
1.16. ‘Course Requirement’ you fulfil the entry requirements including academic requirements and technical requirements and that you have the technical knowledge to undertake the course.

  1. Enrolment

On receipt of the enrolment form, H1 Digital Education may, in its sole discretion, either enrol the student in one or more of the training courses, or decline to enrol the student in one or more of the training courses. If H1 Digital Education declines to enrol a student in a training course, it will notify the Student.

If you have enrolled on our website, by clicking “Accept” at the time of enrolment on our website you confirm that you have agreed to:

  • enrol in the course
  • abide by these terms
  • allow us to capture the internet protocol address (“IP address”) of the device that you used to enrol in the course
  • use the IP address to identify you and confirm your acceptance with these terms.

2.1. If you have enrolled by other means, your signature will confirm that you have agreed to enrol in the course and abide by these terms.
2.2. You must maintain a current email address and check it regularly. You agree that all official communication from H1 Digital Education will be by email
2.3. You will let us know within seven (7) days of any changes to your circumstances including contact details such as address, telephone number or email address
2.4. You confirm that you have supplied H1 Digital Education with information that is accurate and complete
2.5. You confirm that you have supplied H1 Digital Education with suitable information regarding any disabilities or impairments that may impact your ability to do or complete the course. You also confirm that you will inform H1 Digital Education within seven (7) days of any new disability or impairment that happens during your period of enrolment at H1 Digital Education that may impact your ability to do or complete the course, if it is reasonable to do so.

  1. Training Course Participation Terms Of Agreement

3.1. By enrolling in the H1 Digital Education training course you get access to the Diploma course material and any bonus inclusions for 12 calendar months from your enrolment date. Your access to the course material and any included additional services such as bonus live webinars or workshops, will come to an end at the end of 12 calendar months from your enrolment date

3.2. Your enrolment and participation in the course is not transferable. It cannot be sold or given to another person.

3.3. Individual components of the course are not redeemable, transferable, or interchangeable if you are unable to attend or use them during the term of your enrolment.

3.4. As some components of the training course are reliant on external suppliers outside our control, H1 Digital Education reserves the right to change or substitute the original course offering, or components of the course at any stage with alternatives that we feel will be of equal or greater value to you.

3.5. Services may be provided by H1 Digital Education or by authorised contractors or companies as may be determined by H1 Digital Education from time-to-time. Such Services are provided for accredited education and training in accordance with the Australian Quality Training Framework (as applicable). And for non-accredited education and training as applicable to acceptable industry standards.

3.6. H1 Digital Education does not guarantee the services provided by third party suppliers referred you to by us and we are not responsible for any services contracted or provided by third party suppliers.

3.7. Services outages are normal and may happen from time-to-time. H1 Digital Education will take reasonable care to ensure a high level of Services availability, however H1 Digital Education, its staff, agents or contractors will not be held liable for any damage, monetary or otherwise caused by a failure of the Services or any loss of data. In the unlikely event of an abnormal outage for more than a week the duration of the course will be extended by the equivalent duration of the outage. Student agrees that this is the total extent of H1 Digital Education’s liability for any disruption to the Services.

3.8. H1 Digital Education reserves the right to terminate your access to the training course, the course website, this website and any associated course material, or any portion of the course at any time, without notice.

3.9. It is the Student’s responsibility to check to ensure that enrolling in a course at H1 Digital Education and accessing the Service does not break local laws in your jurisdiction.

3.10. Access to the Services may not be available from your jurisdiction, workplace or through your local internet service provider. It is the Student’s responsibility to ensure that accessing the Services is possible from your jurisdiction and internet service provider.

  1. Entry Requirements

4.1. Entry requirements for the H1 Digital Education training course are listed on the website at www.H1Digital.edu.au By enrolling in the course, you;

  • Agree that you fulfil the entry requirements including academic requirements and technical requirements and that you have the technical knowledge to undertake the course.

4.2. It is the Student’s responsibility to ensure that they have suitable course requirements to undertake their course. Unless specifically mentioned as a course inclusion, H1 Digital Education does not provide any such course requirements. H1 Digital Education will not be held liable for a Student not having or being unable to obtain any course requirements. Course requirements include, but are not limited to:

  • stationary
  • computer or tablet device with suitable technical requirements – please see student handbook
  • access to the internet of a reasonable speed and with sufficient download and upload capacity remaining
  • power or batteries
  • storage devices
  • calculator
  • a suitable location to undertake the course
  • other course requirements that a reasonable person would expect would be required to undertake the course.
  1. Course fees

The fees for enrolling in a training course are as set out on the enrolment form (Fees). H1 Digital Education may, from time to time, vary the Fees by publishing those prices within its new enrolment forms. By signing the enrolment form, the student agrees to make full payment of the course cost in Australian dollars. Qualifications, including Statements of Attainment will not be issued to students who have not made full payment for their course. Please advise H1 Digital Education of any changes to your contact or payment details to info@H1digital.edu.au.H1 Digital Education correspondence will be to the email address provided. It is the student’s responsibility to keep H1 Digital Education updated.

In return for the course fees, H1 Digital Education will provide the student with access to the course materials, and the marking of assessments for a 12 month period. Should a student be enrolled into two (2) courses, then the student will have access to one course at a time. If the student elects to pay their course via payment plan, they should note that this does not diminish their liability to meet the entire course cost (i.e. the payment plan allows the student to manage their cash flow but it is not a subscription service that can be cancelled if the student does not complete the course).

In exceptional circumstances, students on payment plans can request deferment of payments for up to three (3) months. H1 Digital Education reserves the right to approve or reject this request.

  1. Additional fees

As a student you may need to pay additional fees or charges such as:

  • fees for documents and items such as transcript of academic record
  • other fees such as deferment of enrolment, course transfer, additional assessment, photocopying/printing online material.
  1. Payment of fees:

The fees must be paid by the student (or an employer) at the time the enrolment form is submitted to H1 Digital Education. The student and the employer each acknowledge that H1 Digital Education will not enrol the student until the fees are paid as per the payment schedule or dates provided. Students will receive an email from H1 Digital Education with information on how to commence your course. It may take up to two (2) business days from the time your payment has been processed to the time you receive an email from us. All transactions are processed in Australian Dollars (AUD).

  1. Failure to notify H1 Digital Education past 90 days from default payment

Once an account is 90 days past due and forwarded to collections, repayment arrangements must be made directly with the collection agency, and the account holder bears the costs associated with collection efforts. We encourage you to make payment in a timely manner and avoid financial penalties.

  1. Refunds

Student course fees are non-refundable once accepted onto the training course and enrolment has commenced. Your payment secures you a place over other applicants and therefore is payable in full, regardless of future changes to your circumstances. If appropriate or an alternative course may be offered. Trainer assessors/training consultants are available to assist students in selecting alternative courses.

If your circumstances change and you are unable to complete the training course, there will be no partial refunds. For example, students will not be entitled to a refund or partial refund for the following reasons; they change jobs, their work hours change, they do not complete the required assessment activities, they do not complete the course within twelve (12) months, they move residences or they change their mind. All transactions are processed in Australian Dollars (AUD).

  1. Intellectual property rights

Any intellectual property rights subsisting in the training materials are owned by H1 Digital Education and, where appropriate, its licensors. The Student and the Employer must not reproduce, modify, enhance, adapt, translate, publish, perform, communicate, or create any derivative work based on, the whole or any part of the Training Materials. The Student and the Employer must not remove, deface or obscure any identification, trademarks, proprietary or copyright notice on any part of the training materials. No intellectual property rights are assigned or licensed by H1 Digital Education to either the Student or the Employer under these terms. The Student and the Employer must not take any action, or cause any third party to take any action, contesting the ownership rights set out in this clause and must do all things necessary or convenient to give effect to this clause 8.

  1. Use of training materials

The Student may use the Training Materials solely for undertaking the Training course to which the Training Materials relate. The Student must not distribute, disclose, sublicense, rent, lease or sell or otherwise grant or transfer any interest in the whole or any part of the Training Materials to any person, except with the prior written consent of H1 Digital Education.

  1. Course extension or deferment

Student ‘course extension’ request form can be obtained from info@H1digital.edu.au prior to course expiry date for all online courses. Student ‘course deferment’ request form can be obtained from info@H1digital.edu.au must be made in writing, once the deferment end date has been reached, payment plans will re-open and payments will continue as previous.

  1. Learning guarantee

If you have signed up for the learning guarantee a free three (3) month course extension available if required, for students to complete their qualification.

  1. Employer obligations

If the Employer is providing monies for an employee(s) course the Employer must:

(a)  Comply at all times with its obligations under the training contract between the Employer and the Student in respect of the Student’s paid Enrolment which has been lodged with H1 Digital Education (‘Training Contract’).
(b)  Provide the Student with appropriate on-the-job training, support and supervision which at a minimum complies with the Training Contract and training plan between the Student, the Employer and H1 Digital Education 12 month time limit (‘Training Plan’).
(c)  Monitor the progress of the student and ensure the Student’s Supervisory form when required is completed and returned to H1 Digital Education in accordance with the Student’s devised and self-paced training plan.
(d)  Comply with the National Code of Good practice for relevant Australian Government and State/Territory laws (including, without limitation, those that relate to occupational health and safety, discrimination and training arrangements).
(e) Promise to pay H1 Digital Education all payments detailed in the payment agreements by the established deadline.

  1. Student obligations

The Student must:

(a) Comply with its obligations in the Training Contract.
(b) Provide their Unique Student Identifier (USI) number when enrolling or within 30 days after enrolment.
(c) Complete the Diploma course within the 12 month time frame specified from enrollment date and make all reasonable efforts to ensure that individual units are completed in a regular and timely manner, for example 1 unit completed per month.
(d) Ensure that the Assessment Sign-Off form and Supervisors Student’s Supervisory form when required for the assessment workbooks are completed.
(e) Comply with the National Code of Good practice for relevant Australian Government and State/Territory laws (including, without limitation, those that relate to occupational health and safety, discrimination and training arrangements).
(f) Understand and agree that withdrawal from H1 Digital Education Training course does not release the student from any payment plan obligations, any financial penalties or other collection cost.
(g) Promise to pay H1 Digital Education all payments detailed in the payment agreements by the established deadline.

  1. Exclusion of liability

To the extent permitted by law and except any implied term, condition or warranty the exclusion of which would contravene any statute or cause any part of these terms to be void (‘Non-excludable Condition’), H1 Digital Education and its related bodies corporate disclaim and exclude all terms, conditions and warranties implied by custom, the general law or statute.

  1. Several liability

An agreement, representation or warranty on the part of two or more persons binds them separately.

  1. Governing law

These terms are governed by the laws in force in Queensland, Australia. The parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of that state and any courts which have jurisdiction to hear appeals from any of those courts and waives any right to object to any proceedings being brought in those courts. These terms constitute the entire agreement between the parties relating to the subject matter of these terms and may only be varied by the written agreement of the parties.

  1. Student policies and procedures

By accepting these terms, you agree to abide by H1 Digital Education policies and procedures, including Recognition Assessment (recognition of prior learning), assessment appeals, complaints handling policy and service delivery standards can be found in the Student Handbook and are available on the H1 Digital Education website at www.H1Digital.edu.au or by calling 1800 819 651. Policies may be updated from time- to- time in accordance with existing laws and regulations.
